Our office understands that discussing and preparing your Will can be an emotional time. It is a difficult conversation for some individuals to have and our office strives to make all clients feel heard and supported during the process.

Wills are documents that state how an individual wants their assets to be distributed upon their death, and who will manage their Estate on their behalf. You should be reviewing your Will on an on going process to ensure any major life changes of importance are reflected in your Will. An example of this could be, divorce or marriage, birth of a child, purchase of a property, or death of a family member. Please note, a Will takes effect only once you have passed away.

There are two types of Power of Attorneys; Continuing Power of Attorney for Property and Power of Attorney for Personal Care. A Continuing Power of Attorney for Property deals with your property, banking and financial matters, etc. The Power of Attorney for Personal Care appoints an individual to make medical decisions on your behalf. These two documents can only be used while you are living. Once you have passed away, they are no longer valid and the Will takes effect.

It is important to note that when someone has become mentally incompetent they can no longer sign a Will or Power of Attorney. Therefore, it is extremely important to ensure that all paperwork is in order before hand.
